IMS Moving Network is an organization specialized in local, national and international transportation and logistics services serving many recognized transportation entities in the industry.
Dear Customer, we thank you for the interest and confidence you have shown towards our company (hereinafter "company"), a division of Internic Moving Services Inc. We aim to make every effort to ensure that you are satisfied with our services. Our experienced team will strive to work on all the details of your move so that it is successful and hassle free.
1. TERMS AND CONDITIONS
By booking your move with us, you declare to have read, understood, and accept all terms and conditions as stated in the quote and contract: https://www.imsmovingnetwork.com/en/deposit/terms/TCVL (hereinafter refered to as "Agreement"). These terms and conditions supersede any other written or verbal agreement that may have been concluded previously. This Agreement is in the English and French language only and shall be governed and interpreted in accordance with the English and French language, regardless of any translations made for any purpose whatsoever.
If you do not wish to accept the terms and conditions in their entirety, you must not proceed with the electronic reservation; otherwise, you will be legally bound. The terms and conditions are applicable at all times to you, to any other person involved in your move (e.g. family members, dependents, co-signer(s), etc.), and to any other person legally representing you. You have read, fully understood and agreed to the terms set forth in this Agreement. You hereby certify that you have had the opportunity to obtain legal advice as to the content of this Agreement and expressly and voluntarily agree to it.
Due to the coronavirus significant impact on the worldwide multimodal international moving industry, the market high volatility, and the inflation instability on moving services and materials, the pricing mentioned above will be valid only fourteen (14) calendar days starting from the date of issuance of the Quote, regardless of the completion of online booking and payment of deposit. At the expiry of this delay, the rates for the services stated in the present in addition to the fees stipulated in the terms and conditions online (ex: fuel, exchange rate, customs clearance fees, sea/air freight and/or road transport, container reservation, etc.) will be reviewed and may be subject to change. Any price increase will remain entirely attributable to the customer and will be effective from the expiry of the period, even if retroactive. However, once the company and/or its representatives have taken possession of the goods (e.g. collection, storage, reception), any increase will be immediately applicable, even if the time limit has not elapsed. In this case, if the increase is refused, the costs related to the services rendered must be paid and the shipment must be repatriated at the customer's expense, as well as all related services (e.g. storage, handling). In any case, rest assured that any increase will be disclosed as soon as possible. We are keeping this matter under careful review and will ensure that you are advised of any developments that may affect the fulfillment of contracted services. The present estimate pricing is not binding upon the company, its affiliates, its suppliers, its subcontractors, and any other third party involved in your move.
2. WEIGHT AND VOLUME ESTIMATE
The weight and volume are estimated according to the standards applicable in the moving industry (i.e. one cubic foot is equivalent to 7 lbs) and according to the details you have provided. The actual weight is determined when the shipment is ready for shipment (packaged and / or palletized) and weighed by the carrier. Thus, it may happen that the estimated weight and volume differ from the actual weight and volume. In any case, the volume or weight that exceeds the initial estimate automatically entails the use of additional services to fulfill the contract.
Please note that the estimate represents the minimum threshold to be paid by the customer. The company is booking in advance the required services from third parties based on the estimate since actual weight and volume are unknown at the time of booking. Among other things, labor, equipment and transport vehicle(s) must be reserved as quickly as possible to avoid any additional delay.
3. BOOKING CONFIRMATION
Any booking confirmed with a deposit has priority of pick up, as per contract projected date, which remains flexible depending on pickup location(s) required on your part. Booking deposit covers administrative fees, moving truck and team scheduling, equipment and materials preparation. Therefore it is non refundable.
4. PICKUP AND DELIVERY
The pickup or delivery dates are in no way guaranteed. However, rest assured that we will take all necessary measures to accommodate you in case of a postponement or change of date. The company cannot be held responsible for any delays caused by public roadways closures, bridges or ferries operating schedule, weather conditions or in case of mechanical or equipment failure, or events outside of the carrier's control, whether in relation to the availability of containers, truckers, or any other unforeseen circumstances requiring the company to change the date of the move. Note that shipping goods to another country requires strict monitoring of procedures that may be required by authorities, such as labeling and professional palletizing of goods.
The company is free to choose the means of performing the contract and we will chose the methods and means to transport your goods, unless otherwise specified or subject to the instructions provided by third parties, the authorities/customs or subject to the practices and customs of the multimodal international transportation industry.
5. SERVICES OUTSIDE OF CANADA
Services that cannot be served by one of our Canadian offices will need to be performed locally by an Agent. Unless otherwise agreed, the company is free to select an Agent of its choice for the fulfillment of its obligations cited in the contract.
The Agent is selected on the basis of the following criteria: the recurrence of the services rendered by the Agent to the company, the quality of its services and its availability.
The cost of materials and the hourly rate for the work will be determined by the Agent according to their normal costs in the location designated for the pick-up or delivery of the goods. These costs may be lower or higher than the rates charged by the company. The price of services to be rendered in the United States will vary depending on the Agent selected, the services required, the location and the period during which the services will be rendered. The costs are generally known from knowledge of the actual weight and volume of the shipment and receipt of the quote issued by the agent.
6. ADDITIONAL AND PROHIBITED SERVICES
Any and all additional services not expressly included on the contract will be to your account.
Additional services excluded from the Agreement can be listed as follows, but are not limited to:

You are responsible for maintaining a valid status for the importation of your goods to the country of destination and we are unable to assist you in this matter.
- And so on.
Prohibited services can be listed as follows (non-exhaustive list):

- And so on.
You are responsible for not presenting for transport or handling / storage any excluded, restricted or prohibited goods.
Goods which, in the opinion of the carrier or of the person who has the custody or possession of the goods, are or may become dangerous or constitute a danger may, at any place and at any time, be unloaded, destroyed and / or made harmless, without the responsibility of the carrier being engaged.
Please note that the company is not obligated to provide a service that was not expressly included in the contract. You therefore accept the risks inherent in the exclusion of a service.
7. PAYMENT
Any balance will be due no later than at the date of pickup, either by certified check, bank draft, direct deposit, bank transfer, Interac e-transfer or cash only. Credit cards are not accepted unless otherwise agreed. In case of non-payment, refusal or impossibility to deliver, you remain fully responsible for the costs and charges related to all services rendered, to the initial transport, to any storage, handling, and redelivery charges, to any consequences resulting from an absence of total or partial payment and for the additional delivery fees, all of this must be paid before the final delivery, otherwise the carrier's right of retention may be exercised.
The Full payment of any invoice is usually an essential condition for the delivery of your shipment. In general, the carrier has the right to retain the transported goods until payment of freight, transportation costs and, where applicable, reasonable storage charges are settled. The pricing is based on the actual weight transported during your move. The actual weight consists of the gross weight. It includes the weight of the goods, the packing material, the pallets, the vaults, and/or any other material needed for the safe transportation of your goods as required by customs. The estimated weight assessed during the survey corresponds to the net weight. The gross weight cannot be estimated since goods assessed for transport are not finalized for shipment. Since the estimated weight represents the minimum threshold to be paid by the customer, it often happens that the customer voluntarily reduces the estimated weight despite the recommendations of our representatives in order to avoid extra charges in the event of a weight lower than the estimate. That said, you agree to be billed on the actual / gross weight of your goods under all circumstances.
All our bank details are indicated on each invoice, which the fastest method of payment is via an Interac e-transfer. Each payment made by the Customer must be accompanied by a proof of payment showing the exact banking data of all parties as follows, but not limited to:
- Date of sending the funds;
- Date of creation of the proof of payment;
- Amount sent and currency;
- Banking and beneficiary details of the sender and receiver.
However, the proof of payment does not represent the confirmation of reception of the said payment by the company, meaning that the funds have to be received in our bank account. This can only be confirmed during business hours on non-holiday days based on the local time of the city of Montreal, in the province of Quebec in Canada.
All payments must be done in the currency approved by the company. At our sole discretion, we will accept payments in Canadian Dollar ($, CAD) and/or in United States Dollar ($, USD). The company is not obligated to display prices in Canadian currency. The applicable currency is clearly indicated in the “Currency” section of the applicable contract and / or invoice. The prices displayed in United States Dollars are intended to facilitate the management of the file in consideration of the services provided in the United States.
Any delay between the sending of the payment, by you or one of your representatives, and the reception of this payment by the company cannot be held against the company and may incur extra fees.
8. CANCELLATION
The company retains the right to cancel the contract, if access to the premises is deemed to be affected, inaccessible or dangerous (e.g. unstable staircase or ramp covered with ice), if the customer refuses to make a payment on time, if the current volume/weight is disproportionate compared to the estimate concluded with the information given by the customer, and/or any other event having a significant impact on the organization of the move.
If you decide to cancel your move at any time, the deposit will not be refunded since it is a non-refundable fee necessary to reserve a moving date and to plan and organize the trajectory of the move. The company reserves the right to keep all sums already paid and to be paid in full for any balance that is due. If services have been rendered, the costs incurred will be retained.
In addition, a 20% charge of the total amount of the contract may be retained as a cancellation penalty, at the discretion of the company; the remaining amount will be refunded (if applicable). The amount kept by the company covers, among other things, the administrative costs, the human resources costs already disbursed and the cancellation of the services of third parties.

In the absence of one of the required documents or in the presence of a late submission, the processing of the complaint may be delayed.
You expressly agree that the maximum amount that may be awarded for any loss or damage to goods, whether as a result of negligence or not, shall be calculated on the following basis:
- (a) the value of the goods at the place and time of shipment with the applicable depreciation; or
The amount of any loss or damage calculated in accordance with the provisions of the above paragraphs must not exceed the agreed amount per lb ($/lb) as marked in the quote / contract, unless a higher value has been declared on the bill of lading or if a transit protection has been taken. The maximum liability is applicable during the transportation of your goods and during their storage.
At the sole discretion of the company, Canadian currency will be prioritized in the event of a claim to assess loss / damage and the market value of the goods will be assessed according to the Canadian market.

Any communication sent to anyone other than the Logistics Manager (or any other person in charge of your move or a specific aspect of it) may result in delays, in which case we will not be held responsible.
The sending of your shipment may require that you fulfill important documentation within a short delay due to the complexity of your move. Therefore, you are responsible to ensure that you have access to the Internet when needed and to plan for the use of a printer/scanner/fax/computer/phone. For instance, the authorities may require that you fill a form only available online. You may have to return it through an intern system that requires the creation of a private account, a user name, and a password.
You accept that any documents be drafted in the English and/or French language. You accept that all documents submitted to be in English and/or French language, except if required in another language following the laws of the origin/destination country. Only the translated version in English and/or French of any documents submitted to our company will be reviewed, therefore you will be responsible to ensure the validity and exactitude of the translation.
You are responsible for the effective management of your email account at all times and to inform us of any changes to reach you. Please note that it is possible for an email to be received in the spam or junk e-mail section; hence you will be held responsible for the consequences of your failure to respond. For example, if you fill a document for customs but do not update the required information in case of changes, you remain responsible for any false declaration/information provided for customs and/or any other authorities. It is extremely important that you communicate any changes to our team that may impact the organization of your move.
You declare to be the legal owner of the goods declared and have the authority and full power to have them transported without restriction to the chosen destination. Should you be acting on behalf of another person, the company will require his or her written authorization as well as his or her legal identity and full contact information.
